The FAR Council implemented a recommendation of the Section 809 Panel that the commercial item definition be bifurcated into “commercial product” and “commercial service” as a way to provide clarity for the acquisition workforce.
Our panel will discuss the revised commercial items definitions and consider issues such as:
Whether the definition is beneficial to acquisition workforce and contractors
Impacts on the shrinking defense industrial base, and innovation from industry.
Impacts and ramifications from recent rulings at Court of Federal Claims regarding commerciality
