WEBINAR - Terminations for Convenience, Maximizing Contractor Recovery

Join NCMA DC on Thursday, February 4 as we hear from Paul Seidman and David Seidman of Seidman and Associates, P.C. about maximizing contractor recovery in terminations for convenience in this important “How To” webinar for contractor executives and procurement attorneys. Terminations for convenience have become more common due to Government downsizing, particularly during this pandemic. Unfortunately, contractors often do not know what costs they are entitled to recover. As a result, they do not claim all allowable costs and accept improper disallowances by the Government or prime contractors. The purpose of the webinar is to provide contractors practical advice on how to prepare a termination for convenience settlement proposal and to familiarize them with pertinent rules so that they receive "fair compensation." The webinar is based on lessons learned by the lecturers in preparing, negotiating and litigating Termination Settlement Proposals.

ABOUT OUR PRESENTERS:

PAUL J. SEIDMAN is a graduate of Temple University and the Georgetown University Law Center. He served as law clerk to the U.S. Court of Claims (now U.S. Court of Appeals for the Federal Circuit) and afterwards as Assistant Counsel for Contract Claims at Naval Sea Systems Command. He served as Assistant Chief Counsel for Procurement in the Office of the Chief Counsel for Advocacy at SBA until entering private practice. Mr. Seidman has served as counsel in bid protests before the General Accounting Office (GAO), and in Federal court. He has extensive claims experience and has appeared as counsel before Boards of Contract Appeals and the U.S. Court of Federal Claims. He has also successfully challenged default terminations and Government defective pricing claims and served as counsel in debarment proceedings. Mr. Seidman has appeared as expert witness in Congressional hearings on various procurement related issues. He was a witness before the Packard Commission. He is also the author of two Briefing Papers on Terminations for Convenience and a series of Nash & Cibinic Report articles covering commercial item terminations for convenience and equitable adjustments on continuing work following a partial terminations for convenience.

DAVID J. SEIDMAN attended the University of Wisconsin, the University of Baltimore School of Law (J.D.), and George Washington University Law School, (L.L.M., thesis pending). He served as law clerk to the Montgomery County Circuit Court in Maryland. Mr. Seidman has been counsel in bid protests, claims, False Claims Act suits, suspensions and proposed debarments. He has developed compliance programs, responded to show cause and cure notices threatening default termination and drafted subcontracts. He has assisted clients in preparing and negotiating termination settlement proposals.
